Procedure of Appeals, Complaints and Disputes

In order to guarantee its principle of creditability, independence, impartiality, transparency, non-discrimination and maintain its interests and the interests of other related parties, CEC accepts applications for appeals, complaints and disputes filed by clients and other related parties through implement relevant procedures of validation and/or verification and certification. The scope including:

?           Validation and/or verification report

?           Validity and impartiality related to validation and/or,verification and certification

?           Illegal and principle-violating behaviors of employees related to activities of CDM project and behaviors that cause damage to legal rights and interests of entrusting party of the project

?           Appeals, complaints and disputes relate to  validation and/or verification and certification from other sources (ex. forwarded by EB and DNA)

Appeals and complaints can be submitted to CEC in forms by written statement and oral description. CEC will make the decision on whether accept the application and notify the party who files the complaint or the related parties within 7 workdays after receive the application.

 

Appeal:

An appeal is a kind of formal written statement which should be proposed to CEC within 30 workdays if the party has objections to CEC’s decision on certification or notification of treatment received by the party.

After receive the relevant information and make the decision of accepting the application CEC should take relevant measures, including making investigation through organizing meeting for getting testimonies from the two parties, on-spot investigation and making consulting to experts to make a valid conclusion.

 

The defending party and the party who file the appeal all have their rights to propose their witness and evidence, which shall be proposed in the written form within 5 workdays before holding meeting/on-spot investigation/consulting to experts.

CEC must make decision on an appeal within 90 workdays after the appeal is submitted to CEC.

For the special reason, the decision making could be delayed before 10 workdays within the 90 workdays to notify the application part after approved by CEC.

 

Complaint:

A complaint can be filed anytime. CEC will propose the opinions or measures on handling the complaint within 45 workdays after it receives the complaint information from relevant parties and make decision of acceptance. CEC will notify the party who files the complaint or related parties by the written form.

 

Dispute:

CEC shall make reply and explanation when the disputes happened between entrusting party of the project and CEC to reach agreement and content of the two parties on the basis of thorough view exchange and equal negotiation.

 

Judgment:

If the two parties have different views, they can file appeals or complaints to EB. They can resort to legal procedures if necessary.
